  1. General

These Terms & Conditions apply to all bookings made with Efoil Fuerte for efoil lessons, sessions, experiences and related activities.

By making a booking, the customer confirms that they have read, understood and accepted these Terms & Conditions.

Efoil Fuerte reserves the right to update these Terms & Conditions from time to time. The version applicable to a booking is the version in force at the time the booking is made.

 

  1. Booking and Confirmation

A booking becomes binding once the booking has been completed and confirmed by Efoil Fuerte or through our booking platform.

The customer is responsible for providing accurate contact and booking information.

The booking confirmation contains the relevant details of the activity, including the date, time, meeting point and number of participants.

The customer must ensure that all participants are aware of and agree to these Terms & Conditions.

 

  1. Prices and Payment

All prices are stated in euros (€) and include the services and equipment specified in the respective booking.

Payment is made through the booking method offered at the time of booking.

Any additional services or charges not included in the original booking will be communicated to the customer where applicable.

 

  1. Cancellation and Rescheduling by the Customer

Customers will receive a full refund or a credit note if they cancel their booking with at least 48 hours’ notice prior to the scheduled activity.

Cancellations or rescheduling requests made within 48 hours of the scheduled activity will incur a 50% cancellation fee.

No-shows will be charged 100% of the booking price.

To cancel or modify your booking, please contact us by phone during business hours (09:30–19:00 local time) or via the contact details provided in your booking confirmation.

The applicable cancellation period is calculated based on the scheduled start time of the activity.

 

  1. Cancellation or Rescheduling by Efoil Fuerte

Efoil Fuerte reserves the right to cancel, postpone or reschedule an activity if the conditions are considered unsuitable or unsafe.

This may include, but is not limited to:

  • unsuitable wind conditions;
  • unsuitable water or sea conditions;
  • dangerous weather conditions;
  • equipment or safety issues;
  • circumstances beyond our reasonable control; or
  • other unforeseen circumstances affecting the safe operation of the activity.

If Efoil Fuerte cancels an activity for these reasons, the customer will be offered either:

  • a full refund, or
  • the opportunity to reschedule the activity, subject to availability.

If an activity has already started but cannot safely be completed due to changing conditions, Efoil Fuerte will determine the appropriate solution based on the circumstances.

Efoil Fuerte is not liable for additional costs incurred by the customer as a result of a cancellation or rescheduling, including accommodation, transportation or other travel expenses.

 

  1. Weather and Safety

Efoil is a weather- and water-dependent activity. The final decision as to whether conditions are suitable and safe for the activity rests with Efoil Fuerte and its instructors.

Weather forecasts alone do not determine whether an activity can take place. Wind direction, wind strength, waves, currents, visibility, water conditions and other local factors may be taken into consideration.

The safety of participants, instructors and third parties always takes priority.

 

  1. Participant Requirements

Participants must follow all instructions given by Efoil Fuerte instructors and staff.

Participants must be able to swim and be comfortable in open water.

Participants must comply with any minimum or maximum age, weight or other requirements communicated during the booking process.

Participants must inform Efoil Fuerte before the activity of any relevant physical limitation, injury, medical condition or other circumstance that could affect their ability to participate safely.

Efoil Fuerte reserves the right to refuse or discontinue participation if an instructor considers a participant unfit or unable to participate safely.

 

  1. Alcohol, Drugs and Unsafe Behaviour

Participants must not take part in the activity while under the influence of alcohol, recreational drugs or any other substance that may impair their ability to participate safely.

Efoil Fuerte reserves the right to refuse participation or remove a participant from the activity if their behaviour presents a risk to themselves, other participants, instructors or equipment.

In such cases, no refund will be provided.

 

  1. Safety Equipment and Instructions

The safety equipment provided by Efoil Fuerte, including helmets and impact vests where applicable, must be worn and used as instructed.

Participants must follow all safety instructions and instructions relating to the use of the efoil equipment.

Failure to follow safety instructions may result in the immediate termination of participation without refund.

 

  1. Equipment

Efoil Fuerte provides the equipment specified in the booking, which may include an efoil board, foil equipment, helmet, impact vest, wetsuit and other necessary equipment.

Participants are responsible for using the equipment carefully and exclusively as instructed by Efoil Fuerte staff.

Participants may be held responsible for damage to equipment caused by intentional acts, misuse or gross negligence, to the extent permitted by applicable law.

Normal wear and tear is not considered damage caused by the participant.

 

  1. Arrival and Late Arrival

Participants must arrive at the agreed meeting point at the time stated in their booking confirmation.

Participants who arrive late may receive a shortened activity in order to avoid delays to subsequent bookings.

If a participant arrives so late that participation is no longer possible, the booking may be treated as a no-show and no refund will be provided.

 

  1. Personal Belongings

Participants are responsible for their personal belongings during the activity.

Efoil Fuerte cannot be held responsible for loss, theft or damage to personal belongings brought to the activity, except where liability cannot legally be excluded.

 

  1. Liability

Efoil is an active water sport involving inherent risks, including falls, contact with equipment, water conditions and other risks associated with participating in the activity.

Efoil Fuerte takes reasonable measures to provide the activity in a safe and professional manner.

Participants are responsible for following all safety instructions and acting with reasonable care.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for death or personal injury caused by negligence where such liability cannot legally be excluded.

 

  1. Insurance

Participants are responsible for arranging any personal travel, accident or other insurance they consider appropriate for participation in the activity.

Efoil Fuerte recommends that participants have appropriate travel and accident insurance covering participation in water sports.

 

  1. Photos and Videos

Efoil Fuerte may take photographs or videos during activities for operational, documentation or promotional purposes.

Where the use of identifiable images for marketing purposes requires consent under applicable law, such consent will be obtained separately.

 

  1. Right of Withdrawal

For bookings relating to leisure activities scheduled for a specific date or period, the statutory right of withdrawal applicable to certain distance contracts may not apply.

This does not affect any mandatory consumer rights that cannot legally be excluded.

 

  1. Complaints

If a customer has a complaint regarding the service, they should contact Efoil Fuerte as soon as reasonably possible so that we have an opportunity to address the issue during or immediately after the activity.

Complaints may be submitted using the contact details provided in the booking confirmation or on our website.

Nothing in this section limits any statutory consumer rights.

 

  1. Force Majeure

Efoil Fuerte shall not be liable for failure or delay in providing the booked service where this is caused by circumstances beyond our reasonable control.

Such circumstances may include severe weather, natural events, government measures, strikes, technical failures, accidents, or other unforeseen events that cannot reasonably be prevented or overcome.

Where possible, Efoil Fuerte will offer an alternative date or a refund depending on the circumstances.

 

  1. Applicable Law

These Terms & Conditions are governed by the laws of Spain.

Nothing in these Terms & Conditions is intended to deprive consumers of mandatory rights granted to them under applicable consumer protection legislation.

Where permitted by applicable law, disputes shall be subject to the competent courts in Spain.
